Bud Terms of Service

1. Welcome to the Team (Agreement to These Terms)

These Terms of Service (the "Terms") are a binding agreement between you and Wunderfan ("Wunderfan," "we," "us," or "our"), the company behind Bud, an AI sports companion you chat with over messaging apps (the "Service").

By texting Bud, adding Bud on a messaging platform, opting in to receive messages from Bud, or otherwise using the Service, you agree to these Terms and acknowledge our Privacy Policy (see Section 14). If you do not agree, do not use the Service. Just don't text Bud, and you can opt out of messages at any time using the options in Section 4.

Your statutory rights are unaffected. If you are a consumer, nothing in these Terms limits or excludes any rights or remedies that the mandatory consumer-protection laws of your country of residence give you and that cannot be waived by contract.

2. Who Can Ride With Bud (Eligibility, 18+ Only)

The Service is intended only for individuals who are 18 years of age or older (or the age of majority in your jurisdiction, if higher). Because Bud discusses sports betting lines, spreads, and odds as part of its commentary, the Service is strictly not for minors.

By using the Service, you represent and warrant that:

  1. You are at least 18 years old (or the age of majority where you live, if higher);
  2. You have the legal capacity to enter into these Terms;
  3. You are not prohibited from using the Service under any applicable law;
  4. You are not located in a country or territory subject to a comprehensive US government embargo, and you are not on any US government list of prohibited or restricted parties; and
  5. All information you provide to us is accurate.

Where Bud plays (availability). We may restrict access to the Service, or restrict specific features (including betting-line, spread, and odds content), by jurisdiction at any time, including where required by law or by the policies of the messaging platforms we operate on.

The Service is not directed at children. We do not knowingly collect personal information from children under 13 (per COPPA). The 18+ requirement applies to everyone under 18: if we learn that a user is under 18, we will close the account, stop all messaging and profiling, and delete the associated personal data (see the Privacy Policy for details).

3. What Bud Is (Description of the Service)

Bud is an AI-powered sports companion that chats with you over messaging channels such as iMessage, Telegram, and WhatsApp. Among other things, Bud may:

  • Send you proactive, recurring messages about sports (scores, news, storylines, game reminders, and commentary) based on the teams, players, and sports you care about;
  • Respond to your questions and messages about sports;
  • Personalize its messages over time based on your conversations and stated preferences; and
  • Reference betting lines, spreads, and odds as part of its sports commentary (see Section 6. This is information and entertainment only, never betting advice).

We may add, change, suspend, or remove features of the Service at any time.

4. Text Me Back (Messaging Terms and Consent)

How your consent works. When you sign up for Bud, for example through our signup flow or by submitting your phone number or messaging account, we collect your consent to receive recurring automated messages through a clear and conspicuous opt-in disclosure shown to you at that time. These Terms confirm, and do not replace, the consent you give at opt-in.

Two kinds of messages. When you message Bud first, Bud's replies in that conversation are responses to you. Separately, Bud sends proactive, recurring messages (like game reminders, news, and commentary), but only where you have opted in to receive them.

Please read the following carefully:

  • Message frequency varies. Bud sends proactive, recurring messages, and the number of messages depends on your preferences, your conversations, and what's happening in sports.
  • Message and data rates may apply. Your carrier's standard messaging and data rates apply to messages you send and receive. Check with your carrier for details.
  • Opting out. To stop receiving messages: reply STOP (on SMS or iMessage), or send Bud the word "stop" or use the block, mute, or report feature on your messaging platform (Telegram, WhatsApp). We will also honor any reasonable opt-out request sent in the conversation or emailed to support@budknowsball.ai. You may receive one final message confirming your opt-out.
  • Getting help. Reply HELP (on SMS or iMessage), ask Bud for help in the conversation, or contact us at support@budknowsball.ai.
  • Consent is not a condition of purchase. Your consent to receive recurring automated messages (including marketing or promotional messages) is not required as a condition of purchasing any goods or services.
  • Carriers are not liable. Mobile carriers are not liable for delayed or undelivered messages.
  • Keep your number current. You agree to notify us if you change or deactivate your phone number, and you represent that you are the subscriber or customary user of the number you provide.

Messaging on third-party platforms (iMessage, Telegram, WhatsApp) is also subject to those platforms' own terms and controls, including their block, mute, and report features.

5. Bud Is Smart, Not Perfect (AI Disclaimer)

Bud's responses are generated by artificial intelligence. That means:

  • Bud can be wrong. AI-generated responses may be inaccurate, incomplete, outdated, delayed, or misleading, including scores, stats, schedules, news, lines, spreads, and odds.
  • Verify before you rely. Do not rely on Bud's messages as your sole source for any decision. Always confirm important information with official or authoritative sources.
  • Not professional advice. Nothing Bud says is financial, legal, medical, tax, betting, or other professional advice. Bud is a companion for sports conversation and entertainment.
  • Bud is not a person. Bud is a software character. Its personality, opinions, and "takes" are generated content, not statements of fact or advice from Wunderfan.
  • Bud will always be identified as an AI. You are never chatting with a human.

You use Bud's outputs at your own risk.

6. Bud Doesn't Take Bets (Sports Betting Disclaimer)

This section is important. Please read it in full.

  1. Information and commentary only. Bud may mention betting lines, spreads, odds, and related information as part of its sports commentary. This content is provided for informational and entertainment purposes only.
  2. Bud is not a sportsbook. Wunderfan is not a sportsbook, casino, gambling operator, bookmaker, or betting exchange. The Service does not accept, place, facilitate, broker, or process wagers of any kind, and no money can be bet through the Service.
  3. No betting advice. Nothing in the Service is a recommendation, endorsement, solicitation, or inducement to place any bet. Bud does not provide betting, handicapping, or wagering advice, and no message from Bud should be treated as such.
  4. No guarantee of outcomes. Sports outcomes are unpredictable. We make no representation or warranty about the accuracy of any line, spread, or odd, or about the outcome of any game or wager. Lines and odds change constantly and the figures Bud shares may be delayed or outdated.
  5. You are solely responsible. Any gambling decision you make is yours alone. Wunderfan is not responsible or liable for any losses, damages, or consequences arising from wagers you place with any third party.
  6. Follow your local law. Sports betting is illegal or restricted in many jurisdictions. It is your responsibility to know and comply with the laws that apply to you. Do not use information from the Service in furtherance of unlawful gambling. We may also restrict betting-related content by jurisdiction as described in Section 2.
  7. You can turn off the betting talk. You may ask Bud to stop including betting lines, spreads, and odds in your messages at any time, and we will honor that preference, without opting you out of Bud's other messages.
  8. If gambling stops being fun, get help. If you or someone you know has a gambling problem, help is available. In the US, call or text 1-800-GAMBLER, or visit ncpgambling.org.

7. House Rules (Acceptable Use)

You agree to use the Service only for lawful, personal purposes. You will not:

  • Use the Service in violation of any applicable law or regulation;
  • Send Bud content that is unlawful, threatening, harassing, hateful, defamatory, obscene, or that infringes anyone's rights;
  • Abuse, spam, flood, or attempt to overwhelm the Service, or use it in a manner intended to disrupt or degrade it;
  • Attempt to reverse engineer, decompile, disassemble, or otherwise discover the source code, models, prompts, or underlying components of the Service, except where such restriction is prohibited by law;
  • Scrape, harvest, or systematically extract data, content, or outputs from the Service, whether manually or by automated means;
  • Use the Service to harvest, collect, or store personal information about others;
  • Impersonate any person or entity, or misrepresent your affiliation with anyone;
  • Use the Service to develop a competing product, or use outputs to train competing AI models;
  • Resell, sublicense, or commercially exploit the Service or its outputs without our prior written consent; or
  • Circumvent any security, rate-limiting, or access-control measures.

We may throttle, suspend, or terminate access for violations of this section.

8. Your Words Stay Yours (User Content License)

You own the messages and other content you send to Bud ("User Content"). By using the Service, you grant Wunderfan a non-exclusive, worldwide, royalty-free, sublicensable (to our service providers) license to use, host, store, reproduce, process, transmit, and display your User Content solely as needed to operate, provide, maintain, personalize, secure, and improve the Service and to comply with law. This license ends when your User Content is deleted from our systems, subject to reasonable backup and legal-retention periods.

AI processing and training. Your messages are processed by third-party AI/model providers acting on our behalf to operate the Service (see the Privacy Policy). We do not use your conversations to train or fine-tune AI models, and we contractually prohibit our AI providers from doing so. The license you grant above does not include the right to train AI models on your User Content; "improve the Service" means things like fixing bugs, tuning prompts, and improving features using aggregated or de-identified insights, not model training on your conversations.

You represent that you have the rights necessary to send us your User Content and that it does not violate these Terms or any law.

9. Bud Belongs to Wunderfan (Intellectual Property)

The Service, including the Bud character, name, likeness, personality, branding, logos, software, and all related intellectual property, is owned by Wunderfan or its licensors and is protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights in the Service are granted to you.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service and to use Bud's AI-generated outputs for your personal, non-commercial purposes. You may not use the Bud name, character, or branding, or commercially exploit Bud's outputs, without our prior written permission.

Feedback. If you send us ideas, suggestions, or feedback about Bud or the Service, we may use them without restriction, attribution, or obligation to you.

Copyright complaints. If you believe content available through the Service infringes your copyright, please send a notice with the information required by the Digital Millennium Copyright Act (DMCA) to support@budknowsball.ai. We will respond to valid notices as required by law and may terminate repeat infringers.

10. Other People's Platforms (Third-Party Services)

The Service operates over third-party messaging platforms, and your use of those platforms is governed by their own terms and policies, including Apple (iMessage), Telegram, and Meta (WhatsApp). We do not control those platforms and are not responsible for them, including outages, message delivery failures, or changes to their features or policies.

Sports data, scores, statistics, lines, spreads, and odds referenced by Bud are sourced from third-party data providers. We do not guarantee the accuracy, completeness, or timeliness of third-party data, and such data is provided subject to Sections 5, 6, and 15.

11. Earn Your Stripes (Rewards Program, Coming Soon)

We may in the future offer a rewards, points, or loyalty program in connection with the Service, potentially operated with a third-party partner. If and when a rewards program launches:

  • It will be governed by separate rewards terms, which will be presented to you and will control with respect to the program;
  • Participation will be optional;
  • Rewards will never be conditioned on placing a wager;
  • Any points, rewards, or benefits will have no cash value, are not your property, and create no vested rights; and
  • We (and any partner) may modify, suspend, or terminate the program, or adjust or expire points and rewards, as described in the applicable rewards terms.

Nothing in these Terms obligates us to launch any rewards program.

12. What It Costs (Fees)

The Service is currently free to use (standard carrier message and data rates still apply, see Section 4). We reserve the right to introduce paid features, subscriptions, or premium tiers in the future. If we do, we will provide notice and the pricing and payment terms before you are charged, and no existing free feature will convert to paid without notice. We will not charge you for the Service unless you have affirmatively agreed to pricing and payment terms presented to you. Carrier charges are between you and your carrier.

13. Cutting Ties (Termination)

By you: You can stop using the Service at any time.

  • To stop receiving messages: reply STOP (on SMS or iMessage), send Bud the word "stop" or use the block/mute feature on your messaging platform (Telegram, WhatsApp), or send any reasonable opt-out request in the conversation or to support@budknowsball.ai (see Section 4).
  • To end the agreement entirely: stopping messages is not the same as closing out your relationship with us. To terminate this agreement and request deletion of your data, email support@budknowsball.ai.

By us: We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law, if required by law or a platform partner, or if we discontinue the Service. Sections that by their nature should survive termination (including Sections 5, 6, 8 through 9, 15 through 18, and 20) will survive.

14. Your Privacy

Our Privacy Policy, available at budknowsball.ai/privacy, describes how we collect, use, and handle your information. It is incorporated into these Terms by reference, and it, not these Terms, is where our data practices are explained. Please read it. 15. No Promises (Disclaimers of Warranties)

THE SERVICE AND ALL CONTENT AND OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT MESSAGES WILL BE DELIVERED; OR THAT ANY INFORMATION PROVIDED BY BUD (INCLUDING SPORTS DATA, LINES, SPREADS, OR ODDS) WILL BE ACCURATE, COMPLETE, OR CURRENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. IF YOU ARE A CONSUMER, YOUR STATUTORY RIGHTS UNDER THE MANDATORY LAWS OF YOUR COUNTRY OF RESIDENCE ARE NOT AFFECTED BY THIS SECTION.

16. Limits on Our Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) IN NO EVENT WILL WUNDERFAN, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, DATA PROVIDERS, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR WAGERING LOSSES, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (B) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (i) ONE HUNDRED U.S. DOLLARS ($100) OR (ii) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW, AND IF YOU ARE A CONSUMER, THIS SECTION DOES NOT DEPRIVE YOU OF MANDATORY PROTECTIONS UNDER THE LAWS OF YOUR COUNTRY OF RESIDENCE.

17. You've Got Our Back (Indemnification)

You agree to indemnify, defend, and hold harmless Wunderfan and its officers, directors, employees, agents, licensors, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Service; (b) your User Content; (c) your violation of these Terms or any law; (d) your violation of any third party's rights; or (e) any wager or gambling activity you engage in with any third party.

18. If We Disagree (Dispute Resolution and Governing Law)

Informal resolution first. Before filing any claim, you agree to contact us at support@budknowsball.ai and attempt in good faith to resolve the dispute informally for at least 30 days.

Governing law. These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles.

Courts. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state and federal courts located in Delaware, and you and Wunderfan each consent to personal jurisdiction and venue there, except that, if you are a consumer in the EEA or UK, nothing in these Terms deprives you of the protection of the mandatory laws of your country of residence, and you may bring proceedings in the courts of your country of residence. Your statutory consumer rights are unaffected by these Terms.

19. Changing the Playbook (Changes to These Terms)

We may update these Terms from time to time. If we make material changes, we will provide notice, for example, by message through the Service or by posting the updated Terms with a new "Last updated" date at budknowsball.ai/terms, and material changes will take effect no sooner than 30 days after we give notice.

If you do not agree to an updated version of these Terms, stop using the Service before the changes take effect. Note that these are two different things: to stop receiving messages, use the opt-out options in Section 4; to terminate this agreement and request deletion of your data, email support@budknowsball.ai (see Section 13). Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

20. The Fine Print (Miscellaneous)

  1. Entire agreement. These Terms, together with the Privacy Policy and any supplemental terms we present (such as future rewards terms), are the entire agreement between you and Wunderfan regarding the Service and supersede all prior agreements on that subject.
  2. Severability. If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary (or severed), and the remaining provisions will remain in full effect.
  3. No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
  4. Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
  5. Force majeure. We are not liable for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, government action, internet or carrier failures, or third-party platform outages.
  6. No third-party beneficiaries. These Terms do not create rights for any third party, except that (a) mobile carriers and messaging platforms may rely on the carrier-liability provisions of Section 4, and (b) the persons identified in Sections 16 and 17 may enforce those Sections.
  7. Notices. Legal notices to Wunderfan must be sent by email to support@budknowsball.ai. We may give you notice by message through the Service (including in your conversation with Bud) or via any other contact information you have provided, and you agree that delivery of a notice in your conversation with Bud constitutes written notice to you.
  8. Notice to California users. Under California Civil Code Section 1789.3, California users are entitled to the following consumer-rights notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
  9. Language. These Terms are drafted in English. Where we provide a translation, the English version controls to the extent permitted by applicable law.
  10. Headings. Section headings (including the playful ones) are for convenience only and do not affect interpretation.
